The agreement that governs your use of Once Upon Elly.

1. About These Terms

These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and Once Upon Elly ("Once Upon Elly", "we", "us", or "our"), the operator of the website at https://onceuponelly.com and the related services (together, the "Service").

The Service is operated by Lucky Code Studio, a registered individual business in the Republic of Korea (Business Registration No. 636-59-00277), based at 76 Keunumul-ro, Mapo-gu, Seoul, Republic of Korea. Our country of tax residence is the Republic of Korea. For any question, email support@onceuponelly.com — we respond within 3 business days.

By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who Can Use the Service

  • You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher.
  • You must be an adult parent, guardian, or other caregiver using the Service to create stories for a child in your care, or an adult using the Service for your own creative or personal purposes.
  • The Service is not directed to children. A child may enjoy stories once they have been generated, but the account itself must be held and operated by an adult.
  • You must not be barred from receiving the Service under the laws of the Republic of Korea, your country of residence, or any jurisdiction where you access the Service.

3. Your Account

  • You must provide accurate registration information and keep it current.
  • Sign-in is currently provided via Google OAuth only. You are responsible for maintaining the security of the Google account you use to access the Service and for all activities that occur under your account.
  • If you suspect unauthorized access, email support@onceuponelly.com immediately.
  • One human individual should control one account; we reserve the right to suspend accounts that appear to be operated in bulk or automated in violation of these Terms.

4. What the Service Does

Once Upon Elly is a software platform that generates personalized bedtime stories (as text) and companion audio narration based on inputs you provide (such as a first name, age, and favorite things). You can read the stories in-app, listen to the audio, export supported formats, and share them privately with your family.

4.1 Independent product disclosure

Once Upon Elly is an independent product. We are not affiliated with, endorsed by, or sponsored by any third-party provider of the AI models or services used behind the scenes to generate story text or audio. Our platform provides a custom, parenting-focused interface and added features on top of third-party AI capabilities, and we alone are responsible for the Once Upon Elly product experience.

Only Once Upon Elly's own name, logo, and marketing describe this product. We do not promote the Service using the brand names of any underlying AI model providers.

4.2 Nature of AI output

Story text and audio are generated by machine-learning models based on your inputs. You acknowledge:

  • AI output can contain errors, inconsistencies, or unexpected content despite our best efforts and content safeguards.
  • Output is non-deterministic: two identical prompts can produce different stories.
  • You should review each story before reading it aloud or playing the audio to a child, especially if the child is very young or sensitive to specific themes.

5. Plans, Credits, and Subscriptions

5.1 Pricing and plans

Our current pricing is displayed clearly on the Pricing page. We offer:

  • One-time credit packs — purchased up front and consumed per generation.
  • Subscription plans — billed on a recurring basis (monthly or annually), including a recurring credit allowance and, where applicable, access to premium features.

All prices are shown in the currency indicated at checkout and, where required by law, are inclusive of VAT/GST.

5.2 Payments

Payments are processed by our payment provider Creem, acting as Merchant of Record where applicable. By making a purchase you also agree to Creem's own terms and privacy notice, which apply to the payment transaction itself. We do not store full payment card details.

5.3 Auto-renewal

Subscription plans renew automatically at the end of each billing cycle using the payment method on file, unless you cancel before the renewal date. The renewal charge will use the then-current price of the plan. You will be notified in advance if we materially change the price.

5.4 Cancellation

You can cancel a subscription at any time, for any reason, directly from the Service:

  • In your account dashboard at Settings → Billing, or
  • Through the Creem Customer Portal link provided on your receipts and in the dashboard.

Cancellation stops future renewal charges. You retain access to paid features until the end of the current paid period. We do not prorate mid-period cancellations.

5.5 Refunds

We take refund requests seriously and respond within 3 business days.

  • Unused credits purchased within the last 14 days may be refunded on request, subject to verification.
  • Subscriptions: if the Service was unusable due to a fault on our side, or if you were charged by mistake, contact us within 14 days of the charge for a full refund of the affected period.
  • Generated content is final: once AI credits have been consumed to produce a story or audio file, those specific credits are not refundable (in the same way a completed digital delivery is not returnable), unless the failure was due to our error.
  • Consumer-law rights — if your local consumer-protection law (for example, the 14-day right of withdrawal in the EU, or Korean e-commerce consumer-protection rules) grants you statutory rights that go beyond the above, those statutory rights apply.

If you do not receive a response to a refund request within 3 business days, Creem is authorized to issue a refund on our behalf to ensure customer satisfaction.

5.6 Taxes

Prices may be shown inclusive or exclusive of VAT, GST, or other applicable taxes depending on your region and the payment processor configuration. You are responsible for any taxes that are not collected at checkout.

6. Your Content and Ownership

6.1 What you input

The information you enter to generate a story (a first name or pen name, age, favorites, free-text prompts) is your "Input Content". You may use a pen name or fictional details — we do not require identification of a real child.

6.2 What the AI generates

The story text and audio produced for you are "Generated Content". To the extent allowed by applicable law, you receive a worldwide, perpetual, royalty-free right to:

  • Read, listen to, display, download, and print Generated Content for yourself and your family;
  • Share Generated Content privately with friends and family;
  • Print bound keepsake books of your Generated Content, for non-commercial personal use.

If you want to use Generated Content commercially (for example, to resell printed books or audio, to license content, or to use it in a for-profit product), please contact support@onceuponelly.com for a separate license.

6.3 License you grant us

You grant Once Upon Elly a limited, worldwide, royalty-free license to host, store, process, display back to you, and transmit your Input Content and Generated Content solely for the purpose of operating and improving the Service. We do not use your content to train external AI foundation models, and we do not sell your Input Content or Generated Content to anyone.

6.4 Your responsibility for Input Content

You represent that you have the right to provide any Input Content you enter, and that it does not violate the Acceptable Use Policy in Section 7, any applicable law, or the rights of any third party.

7. Acceptable Use Policy

You agree not to use the Service to create, upload, attempt to generate, or share content that is:

  • Sexually explicit, pornographic, nude, or sexually suggestive, including any depiction of minors in a sexualized context (strictly prohibited; we report such cases to the authorities where required by law).
  • Violent, graphic, or promoting self-harm, terrorism, or hate speech.
  • Harassing, bullying, defamatory, or deceptive toward any real person.
  • Impersonating a real child or adult without their informed consent, or using a real child's identifying information in a way that could harm the child.
  • Infringing on intellectual property, trademarks, or publicity rights (for example, requesting stories featuring copyrighted characters such as branded mascots or real celebrities).
  • Used for face-swap, deepfake, or biometric manipulation — this is not offered, and any attempted abuse of the system for such purposes is forbidden.
  • Illegal, fraudulent, or malicious under the laws of the Republic of Korea, your country of residence, or any jurisdiction where the output is used.

7.1 Automated and human moderation

The Service includes automated content-safety filters designed to block NSFW, violent, and otherwise prohibited outputs. In addition, we reserve the right to:

  • Reject or silently adjust prompts that are likely to violate this Policy.
  • Review user accounts or generated content manually when we detect suspicious activity.
  • Suspend or terminate accounts that repeatedly or egregiously violate this Policy.
  • Report illegal content (including CSAM) to law-enforcement authorities where required by law.

We are solely responsible for the content our Service enables users to generate. Reliance on a third-party AI provider is not a defence against policy violations.

7.2 Reporting

If you believe content generated on the Service violates this Policy, email support@onceuponelly.com with the story ID and a short description. We investigate every report.

8.1 Our IP

The Service's software, brand, name "Once Upon Elly", logos, and site content (other than user content) are owned by Lucky Code Studio or its licensors and are protected by copyright and trademark laws. Nothing in these Terms grants you any rights to our IP beyond use of the Service.

If you believe content on the Service infringes your copyright, send a notice to support@onceuponelly.com including: (a) your contact information, (b) identification of the copyrighted work, (c) the specific URL or story ID, (d) a statement that you have a good-faith belief the use is not authorized, (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights-holder or authorized to act, and (f) your signature (electronic is acceptable).

We investigate and take action within a reasonable time, typically within 7 business days.

9. Third-Party Services

The Service integrates with third-party providers for payment processing, AI model access, email delivery, analytics, and authentication — see our Privacy Policy. We are not responsible for third-party service availability, their outputs, or their own terms and privacy practices beyond how they integrate with the Service.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • the Service will be uninterrupted, error-free, or bug-free;
  • AI-generated content will meet your expectations or be factually accurate;
  • any specific feature will be maintained indefinitely.

Nothing in this section limits your statutory consumer rights where the law does not allow such limitation.

11. Limitation of Liability

To the maximum extent permitted by law, Once Upon Elly and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) US $50.

Nothing in this section limits liability for death, personal injury caused by negligence, fraud, or other liability that cannot be lawfully limited.

12. Indemnification

You agree to indemnify and hold harmless Lucky Code Studio, Once Upon Elly, and their respective operators, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your Input Content, your misuse of the Service, or your violation of these Terms or applicable law.

13. Suspension and Termination

  • You may stop using the Service or close your account at any time, from Settings → Account, or by emailing us.
  • We may suspend or terminate your access if you materially breach these Terms (for example, the Acceptable Use Policy), if we are legally required to do so, or if your account activity creates a serious risk of legal, security, or reputational harm.
  • Provisions that by their nature survive termination (including Sections 6, 7, 8, 10, 11, 12, and 14) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved informally will be submitted to binding arbitration in the Republic of Korea under the rules of the Korean Commercial Arbitration Board (KCAB), unless local mandatory law gives you the right to bring the dispute before the courts of your place of residence.

You agree to first contact support@onceuponelly.com and attempt a good-faith resolution for at least 30 days before commencing any formal proceeding. Consumer-law rights in your jurisdiction are not waived by this section.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with an updated "Last updated" date. For significant changes, we will also notify the email on your account. Continuing to use the Service after the changes take effect means you accept the updated Terms.
